AI Use & Disclosure Policy

At Jreami Design, I believe in being transparent about how products are created and how technology is used in my business. This policy discloses where and how artificial intelligence tools are used across my products, services, and website content.

1. AI Generated Products

1.1   Some digital products sold through the Jreami Design store contain imagery or content that has been generated using artificial intelligence. This includes but is not limited to scene kits, background asset packs, and any other digital products where AI generation has been used in the creation process. Product listings will indicate where AI generated content has been used.

1.2   AI generated content in Jreami Design products is created using professional AI platforms. These include but are not limited to tools such as image generation platforms, language models, video generation tools, and creative AI software (examples of the types of platforms used include tools in the category of ChatGPT, Claude, Higgsfield, Midjourney, DALL-E, Runway, and similar). Jreami Design operates on paid commercial plans with all AI tools used, which grant full commercial rights to generate, sell, and distribute AI generated outputs under each platform's respective terms of service. 

1.3   By purchasing a product containing AI generated imagery, the buyer acknowledges that they are aware the product contains AI generated elements and accepts this as part of their purchase. No refund will be issued on the basis that a product contains AI generated content where this has been disclosed.

2. Buyer Licence for AI Generated Products

2.1   AI generated products are sold under a commercial use licence. The buyer may use the assets in their own design work, client projects, mockups, digital products, and commercial materials, subject to the restrictions in Clause 2.2.

2.2   The buyer may NOT:

a.   Resell, redistribute, or sublicense the raw AI generated assets as standalone files or as part of another digital product, template pack, or asset bundle.

b.   Claim to have personally created the AI generated imagery or misrepresent the origin of the assets.

c.   Use the assets as training data for any artificial intelligence model, machine learning system, or automated tool.

d.   Attempt to trademark or register intellectual property rights in any design, logo, or creative work that consists solely or substantially of AI generated imagery, as AI generated content is not currently eligible for trademark or copyright protection in most jurisdictions.

2.3   These restrictions apply to the AI generated elements within the product only. Any original design elements created by Jreami Design and incorporated into the product remain the intellectual property of Jreami Design.

3. Similarity & Uniqueness

3.1   AI image generation tools can produce visually similar or comparable outputs for different users and prompts. Jreami Design does not guarantee that AI generated assets sold in its products are entirely unique or that other buyers of the same or similar products may not receive comparable imagery.

3.2   Jreami Design is not liable for any similarity between assets purchased from this store and AI generated imagery obtained by other buyers, whether through Jreami Design or any other source.

3.3   If uniqueness of imagery is essential for your intended use, you are advised to consider this before purchasing AI generated asset products.

4. AI Assisted Copy & Content

4.1   Some product descriptions, website copy, and marketing content on the Jreami Design website and store may be drafted with the assistance of artificial intelligence writing tools. All AI assisted copy is reviewed, edited, and approved by Jreami Design before publication and reflects the genuine voice, values, and offerings of Jreami Design.

4.2   AI tools are NOT used to generate client deliverables. All branding, logo, website, packaging, and social media designs produced for clients are created by Jordan using professional design software. AI generated imagery is not used in client project deliverables unless explicitly agreed in writing with the client before the project begins.

5. Client Projects & AI Feedback

5.1   As outlined in all Jreami Design service agreements, feedback on client projects must be the client's own original thoughts and creative direction. Feedback generated by or substantially influenced by artificial intelligence tools will not be accepted and will be returned to the client for resubmission in their own words.

5.2   The Designer's creative process is founded on the client's genuine vision and brand identity. AI generated feedback does not reflect the client's authentic voice and is not an acceptable basis for design decisions.

6. Updates to This Policy

6.1   The use of AI tools in creative and business contexts is evolving rapidly. Jreami Design reserves the right to update this policy as tools, licensing terms, and legal frameworks change. The most current version of this policy will always be available on the Jreami Design website.

6.2   Continued use of the Jreami Design website or store after any update to this policy constitutes acceptance of the updated terms.

7. Third Party Platform AI Features

7.1   The Jreami Design store is hosted on Shopify. Shopify and its associated tools may use artificial intelligence features in the operation of the store, including but not limited to AI generated product descriptions via Shopify Magic, AI powered customer support features, AI assisted search and recommendations, and any AI features built into third party Shopify apps installed on the store. These features are operated by Shopify and their respective third party providers and are subject to Shopify's own terms of service and privacy policy.

7.2   Jreami Design does not control Shopify's AI features and is not responsible for AI generated content or recommendations produced by Shopify's platform or any third party app operating within the store.

7.3   If a chatbot or AI powered customer support tool is active on the Jreami Design store, it is intended to assist with general enquiries only. Any responses generated by an AI chatbot do not constitute a formal agreement, quote, or commitment from Jreami Design. All formal communication, project agreements, and contractual matters must be confirmed in writing by Jordan Gichuhi directly via contact@jreamidesign.com.
