Terms & Conditions

These Terms and Conditions govern all purchases made through the Jreami Design Shopify store (shop.jreamidesign.com) operated by Jordan Gichuhi, Director of Jreami Design. By completing a purchase, the buyer confirms they have read, understood, and agree to be bound by these terms in full. These terms are governed by the laws of the United States of America.

1. Products & Services Sold

1.1   The Jreami Design store sells two categories of products: (A) Design Services, including social media post design bundles and packaging design services, and (B) Digital Products, including Affinity mockups, Canva templates, scene kits, and other downloadable design assets.

1.2   The terms applicable to each category differ and are set out below. By purchasing, the buyer confirms they have read and accept the terms relevant to their purchase.

2. Digital Products | Terms of Sale

2.1   All digital product sales are final. No refunds, exchanges, or credits are offered on any digital product under any circumstances, including but not limited to change of mind, accidental purchase, incompatibility with the buyer's software version, or failure to read the product description before purchasing.

2.2   Due to the nature of digital products, files are made available for download immediately or shortly after purchase. Because the product can be accessed and retained upon download, all sales are non-refundable once the file has been made available.

2.3   It is the buyer's responsibility to read the full product description, including software requirements, compatibility notes, and file format details, before purchasing. Jreami Design is not liable for purchases made without reading the product description.

2.4   Digital products are licensed for the buyer's own personal or commercial use only, as specified in each product listing. Unless otherwise stated, the buyer may not resell, redistribute, share, sublicense, or offer the digital product or any part of it to third parties, whether free of charge or for profit.

2.5   All digital products remain the intellectual property of Jreami Design. Purchase grants a licence to use the product, not ownership of the underlying files, concepts, or designs.

2.6   If a file is corrupted, incomplete, or fails to download correctly, the buyer must contact contact@jreamidesign.com within 7 days of purchase with proof of the issue. Jreami Design will provide a replacement file. This does not constitute a refund.

2.7   Jreami Design does not provide technical support for third-party software. If the buyer experiences difficulty using the product within their design software, they are responsible for seeking support from the relevant software provider.

3. Design Services | Terms of Sale

3.1   All design service purchases through this store are subject to the Jreami Design service agreement applicable to the service booked. A contract will be sent to the buyer's email within 1 to 2 business days of purchase and must be signed before work begins.

3.2   Payment made at checkout constitutes a non-refundable retainer that secures the buyer's exclusive project slot in the Designer's schedule. By completing payment, the buyer acknowledges and accepts that the payment is non-refundable, subject only to the early cancellation provision and Designer unforeseen circumstances clause set out in the applicable service contract.

3.3   The early cancellation provision is as follows: if the buyer cancels in writing within 7 days of payment AND more than 30 days before the confirmed start date, the Designer will retain 25% of the total project fee and refund the remaining 75%. Outside of this window, or where the confirmed start date is within 30 days of payment, or once work has commenced, the payment is non-refundable in full.

3.4   If the buyer terminates the project at any point after work has commenced, 100% of the payment is forfeited as a kill fee. No refund, credit, or compensation will be issued.

3.5   The full terms governing design services, including deliverables, revisions, timelines, client responsibilities, chargebacks, and intellectual property, are set out in the service contract sent after purchase. The buyer is required to read and sign this contract before the project begins.

3.6   Design services purchased through this store are subject to the same onboarding requirements as services booked through any other channel. An onboarding form will be sent after the contract is signed and must be completed in full before the project start date.

4. Chargebacks & Payment Disputes

4.1   By completing a purchase, the buyer agrees not to initiate a chargeback, payment reversal, or dispute through any bank, card provider, or payment processor in relation to their purchase.

4.2   For digital products: initiating a chargeback after a digital product has been made available for download is considered fraud. Jreami Design will contest all such chargebacks and submit download logs, purchase records, and these terms as evidence.

4.3   For design services: initiating a chargeback after work has commenced is a material breach of the service contract. All work reverts immediately to the intellectual property of Jreami Design, the buyer loses all rights to use any designs produced, and Jreami Design reserves the right to pursue the full invoice amount through legal proceedings.

4.4   If the buyer has a genuine concern about their purchase, they must contact contact@jreamidesign.com before initiating any third-party dispute. Jreami Design will make reasonable efforts to resolve the concern within 14 days of receiving written notice.

5. Intellectual Property

5.1   All designs, digital products, templates, mockups, assets, and creative work sold or produced by Jreami Design remain the intellectual property of Jordan Gichuhi, Director of Jreami Design, until full payment has been received and, in the case of services, all deliverables have been formally completed and delivered.

5.2   Digital products are sold under a licence for the buyer's use as specified in the product listing. This licence does not transfer ownership of the underlying intellectual property.

5.3   Completed design service deliverables transfer to the buyer upon receipt of full payment and formal delivery, subject to the terms of the applicable service contract.

5.4   The buyer may not copy, replicate, reverse engineer, or use Jreami Design's products or designs as the basis for competing products.

6. Limitation of Liability

6.1   Jreami Design's total liability for any claim arising from a purchase through this store shall not exceed the amount paid by the buyer for the relevant product or service.

6.2   Jreami Design is not liable for indirect, incidental, or consequential damages including lost revenue, lost profits, or business losses arising from the use or inability to use any product or service purchased.

6.3   For digital products, Jreami Design is not liable for any issues arising from software incompatibility, user error, or changes to third-party software after the date of purchase.

6.4   For packaging design services, Jreami Design is not liable for print errors, colour variations, or production issues arising from the printing or manufacturing process. The buyer is responsible for requesting and approving a physical proof from their printer before a full print run.

7. Privacy

7.1   Personal information collected during purchase is used solely to process the order, deliver the product or service, and communicate with the buyer regarding their purchase. Jreami Design does not sell or share personal data with third parties except where required to fulfil the order.
